The plaintiff sued under the safe-place statute to recover for injuries sustained when she caught her foot and fell over a horoscope weighing scale in the defendants store. The jury found the defendant causally negligent in failing to place the scale in such a position as to render the premises in as safe a condition for frequenters as the nature of the store would reasonably permit. The jury also found the plaintiff was contributorily negligent, apportioned the total negligence 80 per cent to the defendant and 20 per cent to the plaintiff, and assessed damages in the amount of $2,230. The trial court set aside the verdict and granted the motion of the defendant for a directed verdict on which the court had reserved its ruling. Judgment was accordingly entered.
